The e-store Tflags.com is operated by OÜ 5-Õiget, registry code 12739319, located at Harju County, Tallinn, Pärnu mnt 82-74, 10131 (hereinafter referred to as the Service Provider), and the customer who places an order in the E-store and identifies themselves by entering their personal data (hereinafter referred to as the Service User), have entered into this E-store User Agreement (hereinafter referred to as the Agreement).

1. E-Store

1.1. The online store (www.tflags.com) created by the Service Provider facilitates the sale of products to the Service User.

2. General Terms

2.1. The terms of this Agreement apply to purchases made in the Tflags.com e-store.

2.2. The parties shall be guided by the Law of Obligations Act, other laws of the Republic of Estonia, and other legal acts, as well as the terms agreed upon in these Terms and Conditions, in regulating their mutual relations.

2.3. The Service Provider reserves the right to make changes to the e-store services at any time.

2.4. The Service Provider has the right to unilaterally modify the terms of this Agreement without being obligated to notify the Service User in writing via email.

2.5. The Service User has the right to download or print these Terms and Conditions, ensuring the possibility of saving and reproducing the information on a permanent data carrier.

3. Products and Purchase Completion

3.1. The Service User selects the desired products and is then required to enter the necessary data for order fulfillment (surname, first name, contact phone number, email) and pays for the products via bank transfer or through an installment payment service.

3.2. The Service User is obligated to provide accurate data necessary for order fulfillment. The Service Provider is not responsible for the non-fulfillment of an order or any resulting consequences due to incorrect data provided by the Service User.

3.3. The sale is concluded, and the contractual obligation becomes effective when the Service User has paid for the order via bank transfer using the payment link in the E-store or made a transfer based on the issued invoice or entered into an installment agreement with the installment service provider.

3.4. The displayed products are generally in stock or can be ordered from suppliers within a reasonable time.

3.5. If a product is out of stock, the order is accepted, and a backorder is placed with OÜ 5-Õiget’s suppliers. Upon receipt, the product is forwarded to the customer. If the deadline (20 days) is not acceptable to the e-store customer, the Service Provider is obligated to refund the payment to the customer.

3.6. Product images are for illustrative purposes only and may differ from the actual product. The Service Provider makes every effort to provide accurate and high-quality product descriptions, but despite this, the descriptions in the e-store may not be exhaustive and may contain unintentional errors.

3.7. Products offered in the e-store are sold to both private individuals and legal entities.

3.8. The Service User confirms that they are at least 15 years old.

4. Prices

4.1. All prices in the e-store are in euros and include VAT, if the Service Provider is a VAT payer.

4.2. The Service Provider reserves the right to change displayed prices at any time. If the e-store user has submitted and paid for an order, the Service Provider is obligated to deliver the corresponding products at the prices valid at the time of the order.

4.3. The Service Provider has the right to refuse to fulfill an order if a technical error has caused the product price in the e-store to be incorrect.

5. Delivery Time and Conditions

5.1. In Estonia, goods are delivered via Unisend, DPD, and SmartPost parcel machines. In Latvia and Lithuania, delivery is via Unisend and SmartPost. In Finland and Sweden, delivery is via SmartPost parcel machines. International shipments are delivered via DPD.

5.2. Orders are typically delivered within 3-5 business days, or up to 20 days if restocking is required.

5.3. Free shipping is provided for orders of at least €100 (Estonia, Latvia, Lithuania). For Finland and Sweden, free shipping applies to orders of at least €150.

5.4. Shipping fees are displayed according to the selected country.

6. Withdrawal from the Agreement Before Fulfillment by the Service Provider

6.1. If the Service User wishes to withdraw from the Agreement after placing an order but before fulfillment by the Service Provider, they must notify the Service Provider as soon as possible. The notice must be sent to the Service Provider’s email at tflags@tflags.com, including the order number, contact details (first name, surname, order date, phone number).

6.2. If the withdrawal request reaches the Service Provider after fulfillment, the withdrawal is processed according to the "Right of Return" section.

6.3. The Service Provider will refund the payment within 14 business days of receiving the withdrawal request.

6.4. The refund will be transferred to the same account from which the payment was made.

6.5. The Service Provider has the right to withdraw from the Agreement or cancel it if the ordered product is out of stock.

6.6. The Service User will be notified of the withdrawal or cancellation without delay via phone, email, or mail. Any prepayments will be refunded immediately but no later than within 14 days.

7. Right of Return and Return Procedure

7.1. The buyer has the right to withdraw from the transaction without giving a reason within 14 calendar days of receiving the order by notifying the seller in a reproducible written form and returning the order via a parcel machine. The buyer must return the product within 14 calendar days of receipt.

7.1.1. The withdrawal period is calculated from the day the buyer or a designated third party (not the carrier) receives the product. For multiple shipments, the period starts from the last delivery.

7.1.2. The right of withdrawal does not apply to legal entities.

7.2. The buyer bears all direct return costs unless the returned product does not match the order.

7.2.1. The return fee via parcel machine or courier is €3.50, paid by the buyer unless the return is due to a mismatch (e.g., wrong or defective product).

7.3. Buyers can return SmartPOST, Unisend, or DPD parcels within 14 days using the door code or return code from the delivery SMS. If the machine issues a return label, affix it over the original label.

7.3.1. For SmartPost returns, use the original door code. For DPD returns, contact tflags@tflags.com.

7.4. Upon withdrawal, the seller refunds the payment minus the €3.50 return fee within 14 days of receiving the product or proof of return.

7.5. The returned product must be unused, complete, in original packaging, and undamaged. Customized products are not accepted.

7.6. Custom-made or personalized products cannot be returned.

7.7. Products cannot be exchanged for other items or sizes. If the product does not meet expectations, the order must be returned, and a new order placed. Refunds are processed within 14 days.

7.8. The e-store reserves the right to cancel a sale and request product return if the listed price was significantly below market value due to an error.

7.9. The return must include the order number and email or a withdrawal declaration (available HERE).

8. Defective Products

8.1. The e-store is liable for non-conformities or defects present at delivery, detectable within two years. Defects appearing within the first year are presumed to have existed at delivery.

8.2. Defective products will be repaired, replaced, or refunded.

8.3. Buyers must report defects within two months via email to tflags@tflags.com.

8.4. The e-store is not liable for defects arising after delivery.

9. Dispute Resolution

9.1. A two-year warranty claim period applies under Estonian law.

9.2. The Service Provider is not liable for damages from improper use or delays caused by uncontrollable circumstances.

9.3. Complaints must be sent to tflags@tflags.com. OÜ 5-Õiget will respond within 15 days.

If unresolved, the buyer may contact the Consumer Disputes Committee or the EU Online Dispute Resolution platform.

10. Privacy Policy / Data Security

10.1. The Service User consents to the processing of their personal data.

10.2. Order data is stored for service provision and marketing (if opted-in).

10.3. Secure SSL, MasterCard SecureCode, and Verified by Visa systems are used for payments.

10.4. Card details are processed securely via Montonio (Montonio Finance OÜ).

10.5. A customer relationship is established upon order registration.

10.6. Registered data includes name, city, phone number, and payment method.

10.7. Data is processed by OÜ 5-Õiget and shared only with delivery services.

10.8. Data is not disclosed to third parties unless legally required.

10.9. Users may review, modify, or delete their data.

10.10. Order confirmations and marketing emails (if consented) will be sent.

11. Liability

11.1. The Service Provider’s liability is limited to the product’s sale price.

11.2. The Service User must use the e-store lawfully.

11.3. The Service User is responsible for their devices and software.

11.4. The Service User is fully liable for damages caused by misuse.

13. Disputes

14. Terms of Use

14.1. The Service User must review these Terms.

14.2. By ticking "I agree to the e-store Terms and Conditions," the Service User confirms understanding and acceptance.
